Where a streetcar, facing a " Go" signal at an intersection having an automatic traffic signal device, was standing still when an ambulance, which is an authorized emergency vehicle as defined by Minn. St. 1941, ? 169.01, subd. 5 (Mason St. 1940 Supp. ? 2720-151[4], was approaching from the streetcar motormans right on the intersecting street at a speed of about 15 miles per hour, with red lights displayed and siren signal sounding, visible and audible to other persons in vehicles and stores at the intersection, and the ambulance was clearly visible to the motorman at the place where the streetcar was standing, but which he testified he did not see after making an observation, the question whether the motorman was negligent in proceeding into the intersection so as to cause the ambulance to collide with the side of the streetcar was one of fact under the statutory right-of-way rule governing at such an intersection, which is that the right of way of a streetcar under ? 169.06, subd. 5(a)(1) and (e), (? 2720-1641 and ), to proceed across an intersection with the " Go" signal is restricted and qualified by the right under ? 169.03 (? 2720-155) of an authorized emergency vehicle, as defined in ? 169.01, subd. 5 (? 2720-151[4]), displaying red lights and sounding an audible siren signal, to cautiously proceed into an intersection past a red or " Stop" signal and by the duty under ? 169.20, subd. 5 (? 2720-200[a, b, c]), of the motorman of a streetcar under the circumstances stated to stop clear of any intersection and remain standing until after the authorized emergency vehicle has passed.
